1. Sole Proprietorship
- Owned, managed, and controlled by one individual.
- The owner is the sole risk bearer and the sole recipient of profits.
- There is no separate legal entity between the owner and the business.
2. Joint Hindu Family Business
- Found only in India.
- Membership arises by birth and extends across three successive generations.
- It is governed by the Hindu Succession Act, 1956.
3. Partnership
- A partnership is a relation between persons who agree to share the profits of a business carried on by all or any one of them acting for all.
- The minimum number of partners is two.
- As per section 464 of the Companies Act 2013, the maximum number can be 100, subject to the government-prescribed limit.
Types of Partners and Types of Partnership
- Active partner contributes capital, participates in management, shares profits and losses, and has unlimited liability.
- Sleeping or dormant partner contributes capital, shares profits and losses, has unlimited liability, but does not take part in day-to-day management.
- Secret partner contributes capital, participates in management, shares profits and losses, and has unlimited liability, but the association is not known to the public.
