Nature of Family Laws in India
- Family laws (Personal Laws) govern marriage, divorce, adoption, guardianship, maintenance, succession, etc.
- India follows religion-based personal laws: Hindus (including Sikhs, Jains, Buddhists), Muslims, Christians, and Parsis each have their own laws.
- Sikhs have their own marriage law (Anand Marriage Act) but follow Hindu Law for other family matters.

Human Rights and Gender Perspective in Family Laws
- Constitution guarantees: Preamble (justice, liberty, equality, dignity), Article 14 (equality before law), Article 15 (non-discrimination on grounds of religion, race, caste, sex, or place of birth).
- Articles 25 and 26 guarantee freedom of religion — religious communities use these to resist changes to their personal laws.
- Gender inequalities exist in both Hindu and Islamic family laws.

Institutional Framework — Family Courts
- Family Courts Act enacted in 1984 for creation and functioning of family courts.
- Family courts were established in major cities in late 1980s and 1990s.
- The Act is procedural — does not override substantive family laws.

Role of Lawyers and Counselors — Gender Issues
- Family Courts Act limits the role of lawyers; increases the role of counselors to encourage amicable settlements.
- Lawyers may act as 'amicus curiae' (legal experts) consulted by courts — not as advocates for parties.
- Reasons for limiting lawyers: prevent excessive costs, manipulation, subversive tactics, prolonged litigation.
