Meaning of Constitution

  • A constitution is a body of rules and regulations, written as well as unwritten, by which the government is organised and functions.
  • There can be no state without a constitution of its own.
  • Every state has its own constitution, but every state cannot be called a constitutional state in the democratic sense.

Contents of a Constitution

  • A constitution is the organic or fundamental law of the land.
  • It must provide for the composition and functions of the executive, legislature, and judiciary.
  • The jurisdiction of these organs should be clearly defined to reduce confusion and conflict.

Written and Unwritten Constitutions

  • A written constitution has its provisions written in detail and usually in one formal document or a set of documents.
  • An unwritten constitution has very brief written provisions and most rules exist in usages, customs, conventions, and precedents.
