1. Why an Independent Judiciary is Needed
- Disputes arise between individuals, groups, and the government, so a neutral body is needed to settle them.
- Rule of law means all people are subject to the same law, regardless of wealth, gender, or social status.
- The judiciary protects rights, settles disputes according to law, and prevents dictatorship by individuals or groups.
2. Independence of Judges and Their Appointment
- The Constitution keeps the legislature out of the appointment process of judges to reduce party influence.
- Judges should be chosen for legal knowledge and experience, not political loyalty.
- Judges have fixed tenure and remain in office until retirement age.
3. Chief Justice Appointment and Seniority Convention
- A convention developed that the senior-most judge of the Supreme Court should be appointed as CJI.
- This convention was broken twice.
