Composition of State Legislature

  • The Legislative Assembly is the lower house and more powerful; members are directly elected by the people.

  • Legislative Powers: Makes laws on 66 subjects in the State List and Concurrent List (subject to Central law).
  • Financial Powers: Controls state finances; Money Bills can only be introduced in the Legislative Assembly.
  • Executive Control: Can remove the Council of Ministers through a no-confidence motion.

  • Every member must take an oath before the Governor or a designated person.
  • The oath includes allegiance to the Constitution, sovereignty of India, and faithful discharge of duties.
  • Failure to take oath results in disqualification from voting or receiving privileges.

Relationship Between Assembly and Council

  • The Legislative Assembly is more powerful than the Council.
  • Ordinary Bills: Council can delay for up to 4 months (3 months first, 1 month on second passage).
  • Money Bills: Council can only delay for 14 days; after that, it is deemed passed.
