Composition of State Legislature
- The State Legislature consists of the Governor and either one or two Houses: Legislative Assembly (Vidhan Sabha) and Legislative Council (Vidhan Parishad).
- Most states have a unicameral legislature (only Vidhan Sabha), while a few have a bicameral system (both Vidhan Sabha and Vidhan Parishad).
- The Legislative Assembly is the lower house and more powerful; members are directly elected by the people.
Powers and Functions of State Legislature
- Legislative Powers: Makes laws on 66 subjects in the State List and Concurrent List (subject to Central law).
- Financial Powers: Controls state finances; Money Bills can only be introduced in the Legislative Assembly.
- Executive Control: Can remove the Council of Ministers through a no-confidence motion.
Oath, Tenure, and Membership
- Every member must take an oath before the Governor or a designated person.
- The oath includes allegiance to the Constitution, sovereignty of India, and faithful discharge of duties.
- Failure to take oath results in disqualification from voting or receiving privileges.
Relationship Between Assembly and Council
- The Legislative Assembly is more powerful than the Council.
- Ordinary Bills: Council can delay for up to 4 months (3 months first, 1 month on second passage).
- Money Bills: Council can only delay for 14 days; after that, it is deemed passed.
